Individual Safe Deposit Box

Account holders and non-account holders, resident and non-resident individuals (including sole proprietors) and legal entities (hereinafter - Customer) of "Converse Bank" CJSC (hereinafter - Bank) can use individual safe deposit boxes (hereinafter - Safe deposit box).

                                Individual safe deposit boxes are provided in the following branches/offices of the Bank:

Note

Storage of flammable, explosive or other dangerous property/items (including drugs/medicines, weapons, ammunition, explosive materials and devices, radioactive materials), as well as perishable goods (food, pesticides) is prohibited. The Customer also guarantees that the valuables placed in the Safe deposit box are in no way related to criminal activity.

Attention

In case of early termination of the Safe deposit box agreement on the Customer's initiative, the service fee for the unused period is not subject to refund.

Insurance Deposit

1. When renting an Individual safe deposit box, the Customer makes a one-time deposit in the amount of AMD 25,000, which will be charged to reimburse the losses caused by losing or damaging the key.
  • In case of termination of the Safe deposit box agreement, the Customer receives back the amount of the insurance deposit paid in advance.
   • In case of loss or damage of the Safe deposit box key, the amount of the insurance deposit is not returned to the Customer. If the Customer continues using the Safe deposit box, he repays the amount of the insurance deposit provided for in the Tariffs.
2. In case it is impossible to extend the Safe deposit box agreement after its expiration, AMD 1,000 is charged for each subsequent day of service until the agreement is closed or extended.

Service of Safe Deposit Boxes

Within the term of the agreement, the Customer can use the Safe deposit box (add or take the valuables stored there, perform any action under the agreement) within the hours specified by the agreement.

The following people can act on behalf of the Customer:
1. In case of individuals
• the authorized person, on the basis of the power of attorney issued in the established form on the territory of the Bank or in accordance with procedure prescribed by RA legislation,
• a person affiliated with the customer, based on the statement on the affiliation established by the Bank and the individual Safe deposit box agreement.
2. In case of legal entities
• the head of the latter's executive body,
• authorized representative based on the power of attorney issued by the head of the executive body.

Extension of Safe Deposit Box Rental Period

The rental period of a Safe deposit box can be extended:

1. At the customer's request, given that there is a corresponding provision/clause on an automatic extension in the agreement, as well as on the basis of an application submitted in writing or via remote communication systems. Furthermore, the fee specified in the tariffs is charged if there is a sufficient amount in any of the Customer's bank accounts.
2. On the Bank's initiative, if, at the end of the term, the Customer does not visit the Bank for termination or extension of the agreement, and the Customer has sufficient amount of funds in his bank accounts. The Bank can extend the rent period:
• for the term of the agreement concluded with the Customer,
• to the maximum period for which there are sufficient funds in the Customer's bank accounts.
3. If the Bank becomes aware of the Customer’s death, the process of terminating the Safe deposit box can be extended for a period of 6 months without charging a commission until the heirs appear /visit the Bank/.
 

Note

If the Customer fails to extend the term of the agreement or fulfil the obligation of taking back the deposited valuables /emptying deposit box/, the Bank has the right to open the Safe deposit box within the terms specified by the agreement and at its own discretion either;

·      sell the valuables deposited in the Safe deposit box at an auction in accordance with the procedure established by RA legislation,

·      keep the valuables in the Safe deposit box until the Customer visits the Bank and pays for the additional storage period,

·      send the property to the police or the local self-government body of the Customer's place of residence if the valuables appear to be nonsalable (documents, keys, etc.).

 

Termination of Safe deposit boxes

The service of Safe deposit box is terminated:
1. after emptying the valuables from the Safe deposit box (in case of expiration of the agreement or early termination),
2. on the initiative of the Bank:
2.1 if the rental fee has not been paid,
2.2 if the rental period has been extended for three consecutive years from the funds available in the Bank account, without the Customer visiting the Bank,
2.3 In case of death of the Customer, if no heirs have appeared after 6 months.

You can communicate with Converse Bank CJSC either by post or by email, whichever you prefer. Electronic correspondence is the most convenient, it is 24/7 accessible, is free of any risk of loss of paper-based information (hard copy) and ensures confidentiality.

The resolution of the founder set by the RA legislation or minutes of the general meeting of the founders for the corresponding organizational-legal type of legal entities, if the information on the founder's (shareholders, participants) shares and other data is missing in the statute, moreover:

·         If the shareholders or participants are individuals/natural persons/, information on the number of shares, ID card information, registration address, telephone number (if available),

·          In case the shareholders or participants are legal entities - the statute of the organization, state registration certificate, in case of a joint stock company - a certificate on shareholders possessing more than 5% share from the Central Depository of Armenia, Taxpayer Identification Number - TIN, if it is not included in the state registration certificate,

·         If the shareholders or participants are legal entities - the statute of the organization, the state registration certificate, in case of a joint-stock company- a certificate on the shareholders possessing more than 5% share, Taxpayer Identification Number - TIN.

Certificate of state registration issued by the relevant authority of the given country,

In the case of account-holder customers, documents are not collected twice, instead their availability is checked and amended/added if necessary.
If the submitted documents are not in Armenian, English or Russian, a notarized translation into Armenian is required.

Attention!

The Bank has the right to open the customer’s safe deposit box in the circumstances specified below irrespective of whether or not the customer has given consent or is personally present:

  • In response to a court judgment/decision, decisions of the Compulsory Enforcement Service under the Republic of Armenia Ministry of Justice or other government authorities;
  • If the Bank has reasonable grounds to believe that the Bank's safety and (or) operations are at threat and/or the safe deposit box contains any item prohibited under the terms and conditions or the RA law;
  • There are other circumstances stipulated in the documents containing binding agreement between the parties or prescribed by the Armenian laws and regulations.

The Bank's liability cannot exceed AMD 5,000,000, regardless of the value of the property/item in the Safe deposit box. Therefore, the Customer has the right to insure at his own expense the property/item exceeding AMD 5,000,000.

In accordance with the RA Law on Combating Money Laundering and Terrorist Financing, on the basis of the Know Your Customer Principle, the Bank may require the Customer to provide additional documents or other information, as well as ask questions during verbal communication, for the purpose of conducting due diligence of the Customer.  

Based on the Foreign Account Tax Compliance Act (FATCA) Agreement concluded with the USA, the Bank can collect additional information to clear out your status of a US taxpayer.

The Bank can revise and amend Tariffs and Rates for additional services by giving a notice to the customers in the manner set under the agreement: by posting a message on the Bank’s website (www.conversebank.am), by making the information available in the Bank’s premises, by post-delivery and by other methods offered by the Bank and selected by the Customer, which shall be deemed the proper notification of the Customer.

Settlement of disputes
Any disputes and disagreements between the Customer and the Bank shall be resolved first through mutual negotiation, and should the agreement not be reached by such methods, the disputes and disagreements shall be resolved in accordance with the procedure prescribed by the RA legislation both per court procedure, and through financial system mediator (in case of individuals).

Notice on Financial System Mediator
Please be informed that according to the RA Law on Financial System Mediator, in case of property claims arising out of services rendered to you by Converse Bank CJSC, disputes and disagreements for not exceeding ten million AMD or equivalent foreign currency may be resolved through the Financial System Mediator.

According to an agreement between the Bank and the Office of the Financial System Mediator, the Bank waives the right to challenge the Financial System Mediator's decisions only in relation to property claims not exceeding AMD 250,000 (two hundred and fifty thousand) or equivalent currency, and on transaction amounts not exceeding AMD 500,000 (five hundred thousand) or equivalent foreign currency.
